ORDER

The petitioner has filed this petition seeking to quash the proceedings pending against him in C.C.No.78 of 2018 on the file of the Additional Mahila Court, Madurai, for the offence under Sections 341, 294(b), 323 and 506(2) of IPC.

2. The learned counsel appearing for the petitioner submits that admittedly, there was no injury or hurt caused by the petitioner to the defacto complainant. Therefore, the ingredient of offence under Section 323 IPC is not made out. Hence, the charge sheet is liable to be quashed. Apart from that, the petitioner has also raised several grounds in this petition.

3. The learned Government Advocate (Crl. Side) appearing for the first respondent submits that the grounds raised by the petitioner are matter for trial.

4. Though the petitioner has raised several grounds, this Court is of the opinion that it can be appreciated only during the trial. Therefore, this Criminal Original Petition is closed with liberty to the petitioner to raise all these grounds before the trial Court during trial.
