ORDER
The petitioners herein seek a direction to the respondents to subdivide and grant separate patta in respect of the properties situated in Survey Nos.309/2, 314, 313 and 318, Anjur Village, Pugalur Taluk, Karur District, by considering the judgment and decree dated 12.03.1968 passed in O.S.No.1127 of 1968, on the file of the learned District Munsif, Karur, based on the petitioners' representation dated 26.04.2025. 2.Heard the arguments of Mr.V.Sukumar, learned counsel appearing for the petitioner and Mr.D.S.Nedunchezian, learned
Government Advocate appearing for the respondents. By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.
3.It is the case of the petitioners that the right of the first petitioner's husband and the second petitioner's father, Samiyappan over the subject property was declared by Civil Court in O.S.No.1127 of 1968, on the file of the learned District Munsif, Karur. Based on the Civil Court decree, the petitioners submitted a representation before the respondents seeking subdivision and issuance of separate patta and the same has not been considered. Hence, the petitioners have come before this Court.
4.The learned Government Advocate appearing for the respondents would submit that if the petitioners submit the necessary documents to substantiate their claim over the property, the representation of the petitioner will be considered on its own merits.
5.In view of the same, without expressing any opinion on the merits of the matter, the petitioners are directed to submit the documents in support of their claim before the third respondent within a period of three weeks from the date of receipt of a copy of this order. On receipt of the documents, the third respondent shall consider the representation of the petitioners dated 26.04.2025 and pass final orders on its own merits, within a further period of eight weeks. Accordingly, this Writ Petition is disposed of. No costs.
