O R D E R

This criminal original petition has been filed seeking a direction to the learned Judicial Magistrate Court No.II, Madurai to complete the trial in CC.No.2170 of 2022.

2.The learned Counsel appearing for the petitioner/defacto complainant submits that in this case, only there are seven witnesses, however, the trial Court has not even issued summons to the witnesses. 3.The learned Government Advocate (Crl.Side) appearing for the respondent police submits that since the third and fourth accused have filed a discharge petition and the same is pending, summons has not been issued to the witnesses.

4.Considering the submissions made, this Court is of the opinion that the trial Court is expected to give priority to the old cases. However, the trial Court shall also allot time for these type of criminal cases and try to dispose those cases as expeditiously as possible. 2/5

5.Since it is a case of the year 2022, this Court is not inclined to give a direction to the trial Court. However, it is the responsibility of the trial Court to allow or dismiss the discharge application filed by the accused Nos.3 and 4, within a reasonable time and the trial Court has to allot equal time for all other cases also.

6.With the above directions, this criminal original petition is disposed of.
