2 W.P.(MD)No.14929 of 2024 Prayer: Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus to direct the respondents 1 to 3 to initiate appropriate action against the respondents 4 to 7 and further ensure that ex-communication imposed by them against the petitioner and the people residing in North Street, Sathanur Village, Thiruvaiyar Taluk, Thanjavur District being removed and consequently, permit the petitioner and the people residing in North Street, Sathanur Village, Thiruvaiyar Taluk, Thanjavur District to participate in the Arulmigu Sri Mariamman Temple Festival Scheduled to be held on 08.07.2024 to 10.07.2024 on the basis of the petitioner's representation dated 27.06.2024. 2. The petitioner hails from north street, Sathanur Village, Thiruvaiyar Taluk, Thanjavur District. Allegation made in the writ petition is that the persons hailing from north street have been ex-communicated and not allowed to participate in the petition mentioned festival.

3. My hands are tied. This is because, the fourth respondent herein namely Thiru.Senthil had already filed W.P.(MD)No.14518 of 2024 and it was already disposed of by a learned Judge of this Court. It will not be proper on my part to pass appropriate order that may work at cross purposes.
4. The learned counsel for the fourth respondent clarifies that at present, the festival is conducted only for Mariamman Temple and not Kaliamman Temple. It is further clarified that the persons belonging to north street can take part equally like any other devotee and that there is no question of ex-communication at all. It is to be noted that both north street as well as the other streets of the village are populated only by the people of Kallar community. It is not a case of inter-community dispute.
5. There is also a Kaliamman Temple in the village. The event organizers are called upon to quantify the contribution received from those residing in north street. They are requested to consider returning a substantial portion of the same so that with the said amount, north street people can celebrate the Kaliamman Temple festival independently. This 3/5
4 W.P.(MD)No.14929 of 2024 arrangement is only for this year and regarding the conduct of the festival on future occasions, the issues are left open. It is needles to add that as and when Kaliamman Temple festival is conducted, the fourth respondent and persons from the other streets can take part like any other devotee.
