Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a writ of mandamus, directing the 3rd respondent to implement the order to transfer the patta No.183 for Survey No.69/1A only in the name of Partnership firm namely Keera Pencils by its Managing Partner

after removal of any partners names therein as passed by the 2nd respondent in proceedings in Na.Ka.Aa.9492/95, dated 31.07.1997. For Petitioners : Mr.S.Suresh Kumar For Respondents : Mr.A.Baskaran, Addl. Govt. Pleader.

ORDER

The Writ Petition is filed, seeking a direction to the third respondent to implement the order passed by the second respondent in his proceedings Na.Ka.Aa.9492/95, dated 31.07.1997, and mutate the revenue records in respect of the property situated in Survey No.69/1A only in the name of Partnership firm, namely, Keera Pencils, represented by its Managing Partner, after removal of partners names in Patta No.183.

2. It is the case of the petitioners that 1 acre of property in Survey No.69/1A was purchased in the name of Keera Pencils partnership firm, represented by its Managing Partner. Since in the revenue records the names of individual partners were included, the petitioners moved the second respondent and he passed an order on 31.07.1997 for removal of individual names from the revenue records and maintenance of the same in the name of Partnership firm, represented by its Managing Partner. Thereafter, patta was issued in Patta No.183 in the name of Partnership firm. Subsequently, the

names of individual persons have been included in the said patta. Therefore, the petitioners submitted a representation before the respondents on 23.03.2022, seeking removal of the names of individual persons in the revenue records. The second respondent, in his proceedings O.Mu.A1/1515/2022, dated 02.04.2022, directed the third respondent to consider the earlier order passed by the Sub Collector, Musiri, and take necessary action on the representation of the petitioners. In spite of the same, the third respondent has not considered the request of the petitioners. Hence, the petitioners have come before this Court.

The Additional Government Pleader, who appears for the respondents, would submit that already the second respondent passed an order, directing the third respondent to consider the representation of the petitioners, in the light of the earlier order passed by him. Hence, the representation submitted by the petitioners would be considered within the time stipulated by this Court.

4. In view of the above mentioned submission made by the learned Additional Government Pleader, without expressing any opinion on the merits of the matter, the third respondent is directed to consider the representation of the petitioners, dated 23.03.2022, and pass final orders on its own merits, after issuing notice to petitioners, individuals, whose names

are reflected in the patta, and other interested parties, within a period of eight weeks from the date of receipt of copy of this order.

5. The Writ Petition stands disposed of accordingly. No costs. 30.06.2025 NCC :
