Respondents PRAYER :- Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned order dated 17.04.2026 passed by the 2nd respondent in R.No.3884/A2/2025 and quash the same as illegal and consequently direct the respondents 1 and 2 to appoint an independent inquiry officer.

ORDER

This writ petition has been filed challenging the order passed by the 2nd respondent dated 17.04.2026 thereby appointed the enquiry officer to conduct the departmental enquiry.

2. The petitioner was initially appointed as Multi-Purpose Health Assistant on 04.02.1993. Thereafter, he attained the age of superannuation on 31.03.2025. Prior to his retirement, disciplinary proceedings were initiated against him by the 1st respondent and the petitioner was placed under suspension. Challenging the suspension, the petitioner filed W.P(MD)No.11113 of 2025 and it is pending. Subsequently, the petitioner was issued with a charge memo. After receipt of explanation, the disciplinary authority proceeded to conduct an enquiry by appointing an enquiry officer. However, the enquiry was directed to be conducted in the presence of investigating officer. Therefore, it was challenged and was quashed by this Court in 2/5

W.P(MD)No.10910 of 2026. Now the enquiry officer has been appointed to conduct the enquiry.

3. Learned counsel for the petitioner submits that the petitioner presumes that the enquiry officer would not conduct the enquiry in a fair manner. However, the petitioner failed to substantiate the said allegation as against the enquiry officer. In fact, the earlier order of enquiry was quashed by this Court only on the ground that the enquiry should not be conducted in the presence of the investigating officer. Now an enquiry officer has been appointed to conduct the enquiry. Therefore, this Court finds no infirmity or illegality in the order impugned in this writ petition and the writ petition is devoid of merits

4. Accordingly, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed. 13.05.2026 Index : Yes / No : Yes / No bala 3/5
