THE HONOURABLE MR.JUSTICE T.RAJA W.P(MD)No.14753 of 2016 S.Komala ... Petitioner vs.
The Chief Educational Officer, Theni.
... Respondent Petition filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondent to consider the petitioner's representation dated 04.08.2016 submitted for transfer within a time frame as fixed by this Hon'ble Court.
For Petitioner : Mr.S.Alagusundar For Respondent : Mr.T.S.Mohammed Mohideen Additional Government Pleader
ORDER
S.Komala, wife of Subburaj, has come to this Court seeking issuance of a Writ of Mandamus, directing the respondent to consider her representation dated 04.08.2016, wherein she has asked for transfer from Government Girls Higher Secondary School, Periyakulam, to Kanniappapillaipatti Government Higher Secondary School.
2.Learned counsel for the petitioner would submit that the petitioner, after her appointment as Science Teacher in the respondent Education Department on 15.09.2010, at Pavalakottai Panchayat Union Middle School, Sathiyamangalam Taluk, Erode District, she has been working in the said capacity, however, as she belongs to Theni District, she applied for transfer to her native. Accepting her request, on 01.09.2014, she was transferred to Government Higher Secondary School, Kandamanur, Andipatti Taluk, Theni District. When the respondent has deployed her to Government Girls Higher Secondary School, Periyakulam, by order dated 29.08.2015, on the ground of surplus vacancy, she joined the said school. In the meanwhile, she has come to know that there is a vacancy in Kanniappapillaipatti Government Higher Secondary School, therefore, she made a representation as she has to travel 30 km distance from Theni to Periyakulam and her husband is also https://hcservices.ecourts.gov.in/hcservices/
working in Indian Army, hence, he pleaded, the representation of the petitioner should be considered.
2.But, this Court is not inclined to entertain this writ petition. The reason is, if the petitioner is eligible in the general transfer counselling, she will be invited to take part in the same, further, she has asked for transfer only within 30 kms, therefore, there is no merit in this writ petition, accordingly, the writ petition is dismissed. No costs.
