Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the first respondent to consider the Petitioner's representation dated 10.2.2017 requesting the first respondent to issue patta to the Petitioner in respect of S.No.778/1, measuring 10 cents situated at Thimarasanaickanur Village, Andipatti Taluk, Theni District within the time limit fixed by this Court. ORDER
The Petitioner seeks for issuance a Writ of Mandamus directing the first respondent to consider the Petitioner's representation dated 10.2.2017 requesting the first respondent to issue patta to the Petitioner in respect of S.No.778/1, measuring 10 cents situated at Thimarasanaickanur Village, Andipatti Taluk, Theni District within the time limit fixed by this Court. 2.Mr.D.Muruganandam, learned Additional Government Pleader takes notice for the respondents.
3.By consent of both parties, the main Writ Petition is taken up for disposal, at the admission stage itself. 4.According to the Petitioner, he has been issued with 2-C patta in respect of the land in S.No.778/1,Thimarasanaickanur Village, Andipatti Taluk, Theni District. The Petitioner has submitted a representation to the respondents to issue patta in her name on 25.08.2005 and it appears that the said representation has been forwarded to the third respondent, with a direction to conduct an enquiry and issue patta to the Petitioner. According to the Petitioner, even though the third respondent conducted an enquiry and made spot inspection, till date no decision has been taken nor the same has been communicated to her. The Petitioner has also submitted another representation, dated 10.2.2017 in this regard. But till date, no action seems to be forthcoming. 5.The learned Additional Government Pleader appearing for the respondents has no objection to consider the representation of the Petitioner within the time limit fixed by this Court.
6. Considering the limited scope of the prayer sought for and without expressing any view on the merits of the claim made by the Petitioner and that the learned Additional Government Pleader appearing for the respondents has no objection to consider the representation of the Petitioner, the third respondent is directed to consider the representation of the Petitioner as indicated above, after conducting an enquiry in accordance with law and on merits and dispose of the same within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken to the Petitioner 7.With the above direction, the Writ Petition is disposed of. No costs.
