The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to provide police protection to the petitioner in view of the recommendation made in Na.Ka.P2/413/2016 on the file of the 4th respondent dated 08.08.2016.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
Brief Facts :
3. The petitioner is a registered contractor with the 4th respondent; that on 29.01.2016, the District Collector, Sivagangai District allotted funds to a sum of Rs.15,00,000/- to construct a small bridge in T.Pudhukottai Village vide proceedings in https://hcservices.ecourts.gov.in/hcservices/
Na.Ka.A3/889/2015 dated 29.01.2016; that after getting No Objection Certificate from the Public Works Department, the petitioner made a spot visit to execute the contract work; that more than 100 persons belonging to Bramanakurichi Village obstructed the petitioner to carry out the job; that the petitioner approached the 4th respondent for arranging police protection to construct the bridge; that the 4th respondent also recommended the 2nd respondent by proceedings in Na.Ka.P2/413/2016 to provide sufficient police protection to the petitioner. Though the same was received by the 2nd respondent, no proper action was taken till date, which compelled the petitioner to approach this Court with the relied stated supra.
4. It is seen that the 4th respondent has already written a letter to the 2nd respondent requesting them to give necessary police protection to the petitioner for construction of the bridge, which itself would go to show that execution of construction of bridge work requires sufficient protection. The construction of the bridge is stated to be under 15 lakhs estimate and therefore, any further delay will cause financial loss to the State exchequer.
5. Under such circumstances, the respondents 1 to 3 are directed to consider the representation dated 08.08.2016 of the petitioner and to pass suitable orders in the light of the recommendation made by the 4th respondent, on merits and in accordance with law within a period of two weeks from the date of receipt of a copy of this order.
With the above direction, this Writ Petition is disposed of. No costs.
