ORDER
This Writ Petition filed to direct the respondents to grant permission and protection for Kodai Festival scheduled to be held on 06.07.2023 to 08.07.2023 at Arulmighu Siva Sudalaimada Swamy Thirukovil and Arulmighu Ramar Thirukovil, Cheruppancodu, Karankadu, Kanyakumari District, and also permit to arrange Temporary Electrict Light and Alangara Valavu (Decorative Arch) is to be perform border of our Cheruppancodu Village.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents. 2/5
3. The learned counsel appearing for the petitioner would submit that for very similar representation that was made by the neighbouring village people, permission was granted by the second respondent, on that ground, this petition has been filed.
4. Even though the second respondent is present before this Court, stated that the proposed place is National Highways road, so the petitioner has to obtain permission from the National Highways' authorities. But however, the learned counsel for the petitioner would submit that the proposed place is a village panchayath road, for which, the third respondent is the competent authority to grand permission.
5. After ascertaining the place, which is proposed to put up the above said Arch, the second respondent is directed to consider the representation of the petitioner and dispose the same immediately on its own merits, by taking into account of the ground situation by making enquiry with the third respondent and other competent authority. 3/5
6. With the above direction, this Writ Pettiion stands disposed of. No costs.
