ORDER
(Order of the Court was made by G.K. ILANTHIRAIYAN,J.) This writ petition has been filed seeking a direction to the respondent to consider the petitioner's representation dated 17.04.2026.
2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.
3. The petitioner availed a loan from the respondent Bank in the year 2015. Thereafter, he committed default, and consequently, the respondent issued a demand notice, followed by a possession notice and auction notice. Challenging the possession notice and auction notice, the petitioner filed S.A.No.585 of 2024 under the SARFAESI Act before the Debt Recovery Tribunal, Madurai, and the same was allowed by the Debt Recovery Tribunal, Madurai, on 24.03.2026.
4. Thereafter, the petitioner submitted a representation seeking the balance dues payable to the respondent Bank. It is seen that the demand notice, possession notice, and auction notice had already been issued to the petitioner. Therefore, the petitioner was well aware of the outstanding dues. The present representation appears to have been submitted only to prolong the proceedings and evade the SARFAESI proceedings initiated by the respondent Bank.
5. In view of the above, the relief sought for in the writ petition cannot be granted. Accordingly, the writ petition stands dismissed. No costs.
