Respondents PRAYER: The Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of a Writ of Mandamus or any other appropriate Writ or Order or Direction in the nature of a Writ to direct the 2nd respondent herein to provide necessary treatment with specialist doctors to the petitioner's husband namely A.Rajkumar who is undergoing treatment before him after having sustained grievous injuries in his legs due to the assault made by the 3rd and 4th Respondent herein and the 1st Respondent to conduct enquiry and to take action on the basis of the petitioner's representation made before him dated 07.03.2017. ORDER
This writ Petition has been filed seeking a direction to the respondent direct the 2nd respondent herein to provide necessary treatment with specialist doctors to the petitioner's husband, namely, A.Rajkumar, who is undergoing treatment before him after having sustained grievous injuries in his legs due to https://hcservices.ecourts.gov.in/hcservices/
the assault made by the 3rd and 4th Respondent herein and the 1st Respondent to conduct enquiry and to take action on the basis of the petitioner's representation made before him dated 07.03.2017. 2.Heard, Mr.B.Brijesh Kishore for the petitioner. And Mr.T.S.Mohammed Mohideen, learned Additional Government Pleader for the respondents.
3.It is the case of the petitioner that her husband is an accused in Crime No.75/2017 and that he requires adequate medical treatment for certain ailments.
4.The learned Additional Government Pleader submitted that the petitioner's husband is now undergoing treatment in Government Medical College Hospital, Asaripallam, Kanyakumari District and the learned Additional Government Pleader has also submitted that the accused/petitioner's husband will be given best treatment in the said hospital.
5. Recording the submission, the 2nd respondent is directed to provide adequate treatment to the petitioner's husband for the ailments suffered by him.
6. At this juncture, the learned counsel for the petitioner submitted that the petitioner being the wife of Rajkumar, she can be permitted to visit him in the hospital. In this considered opinion of this Court, the petitioner, on proper identification, should be permitted to visit her husband in the hospital, while he is under treatment, on giving representation to the first respondent.
6. With the aforesaid directions, the Writ Petition is disposed of. No Costs.
