PRAYER :- For Bail in Crime No. 494 of 2020 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/sole accused, who was arrested on 05.11.2020, for the offence punishable under Section 7 r/w. 8, 9(k) r/w.10 of Protection of Children from Sexual Offences Act, 2012, in Crime No.494 of 2020, seeks bail.
2. The case of the prosecution is that the petitioner sexually assaulted a 13-years-old mentally retarded victim girl. Hence, the case.
3. The learned counsel for the petitioner submits that the petitioner is an innocent and he has not committed any offence as alleged by the prosecution.
4. The learned Government Advocate (Crl. Side) submits that this is the second bail petition. The earlier bail petition filed by the petitioner in Crl.O.P.(MD)No.5380 of 2021, was dismissed by this Court, on 16.04.2021.

5. Considering the seriousness of the offence committed by the petitioner and also the fact that the trial commenced, recording of witness and evidence is going on, this Court, vide order 16.04.2021, dismissed the earlier bail petition and directed the trial Court to complete the trial proceedings in Spl.S.C.No.6 of 2021 as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of the order.
6. In view of the above, this Court is not inclined to entertain the second bail petition. Accordingly, the Criminal Original Petition is dismissed.
