PRAYER : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the Impugned Order in Na.Ka.A6/9016/2020 dated 06.11.2020 on the file of the Respondent No.1 and quash the same as illegal in so far as the Petitioner is concerned and consequently direction directing the Respondents to permit the Petitioner to allow to serve as VAO at Ravanasamudram Village Tenkasi Taluk Tenkasi District in B Village for more than three years based on the counselling selection held on 21.10.2020 and in the light of the G.O.No.515, (Revenue Section 7 (1) Department, dated 25.8.2008). ORDER
Challenging the impugned order passed by the 1st respondent in Na.Ka.A6/9016/2020 dated 06.11.2020, the present writ petition has been filed.
2.By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. 3.Though the writ petition is filed for a larger relief seeking issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order passed in Na.Ka.A6/9016/2020 by the 1st respondent, dated 06.11.2020 and for a direction to the respondents to 1/3
permit the petitioner to serve as Village Administrative Officer at Ravanasamudram Village, Tenkasi Taluk, Tenkasi District in B Village for more than three years, based on the counselling selection held on 21.10.2020 and in the light of the G.O.No.515, Revenue Section 7
(1) Department, dated 25.8.2008, the learned counsel appearing for the petitioner in the course of his argument, restricted the relief for issuing a direction to the respondents 1 and 2 to consider and pass appropriate orders on the petitioner's representation, dated 03.11.2020.
4.Mr.K.P.Narayanakumar, learned Special Government Pleader appearing for the respondents would fairly submit that the impugned transfer order dated 06.11.2020 has been passed by the 1st respondent only on the ground that the petitioner was working in the same place for more than 3 years. However, he would further submit that the petitioner's representation dated 03.11.2020 will be disposed of on merits and in accordance with law, within a time frame to be fixed by this Court.
5.In view of the submission made by the learned Special Government Pleader, this Court directs the respondents 1 and 2 to consider the petitioner's representation dated 03.11.2020 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
6.With the above direction, the Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed.
