Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the second respondent to permit the petitioner to conduct cock fight, a traditional game in continuation of Chithirai festival on 16.04.2017 from 07.00 am to 05.00 pm at S.S.N.Thirumana Mandapam, Alangulam, Tirunelveli District and to provide adequate police protection and pass such further or other orders.

ORDER

[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the second respondent to give necessary permission for conducting cock fight in the place mentioned in the petition, by way of issuing a writ of mandamus. 2.Mr.K.Guru, learned Additional Government Pleader, has taken notice for the respondents.

3.The learned counsel appearing for the petitioner has advanced his argument on the basis of the averments made in the petition.

4.The learned Additional Government Pleader appearing for the respondents has represented that with regard to cock fight already three criminal cases have been registered and further the petitioner has been doing this type of practice only for getting profit and therefore the relief sought in the writ petition cannot be granted.

5.It is seen from the records that on 16.02.2017 a representation has been given, but the same has not been considered. Under the said circumstances, this Court is inclined to pass the following order.

6.In fine, this writ petition is allowed in part without costs and the second respondent is directed to look into the representation dated 16.02.2017 and dispose of the same within a period of two days.
