PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents No.1 and 2 herein to produce the body or person of detenue V.G.Gayathri, aged 29 years, daughter of V.S.Chidambaranathan before this Court and set her at liberty. ORDER
(Order of the Court was made by R.SURESH KUMAR, J.) This Habeas Corpus Petition has been filed seeking a direction to the respondents No.1 and 2 herein to produce the body or person of the detenue viz., V.G.Gayathri, aged 29 years, daughter of V.S.Chidambaranathan, before this Court and set her at liberty.
2. When the Habeas Corpus Petition is taken up for hearing, the respondent police has produced the detenue viz., V.C.Gayathri. She stated before us that, she is an Engineering Graduate and during the College days she fell in love with the third respondent, who is also an Engineering Graduate.
3. She would further submit that, since the parents of the detenue did not accept the said marriage proposal with the third respondent, the detenue has left the parental home on 10.05.2023 and on the same date both the detenue and the third respondent have gone to Coimbatore, where they claimed to have solemnized the marriage between them and since then, they 2/4
have been living in Bangalore, where the third respondent is working in a private company.
4. In this context, they seem to have surrendered before the Gandhipuram Police Station, Coimbatore, seeking police protection, pursuant to which, the police have taken some efforts to contact the petitioner, for which, the petitioner seems to have not responded positively to see the detenue, because of his stand that he did not accept the marriage of the detenue with the 3rd respondent.
5. Be that as it may, since both are major and they have already reached the concerned age to marriage and they claimed to have married and living together in Bangalore, this Court feel that, the detenue is not in illegal custody of any one and recording the same, this Habeas Corpus Petition can be closed and accordingly, it is closed.
