This Writ petition has been filed by the petitioner for issuance of a Writ of Mandamus, directing to forbear the second respondent from running the parallel court (Kangaroo Court) in the matter of civil dispute arose between the petitioner and third respondent at the instance of the third respondent. 2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. https://hcservices.ecourts.gov.in/hcservices/
3.When the matter was taken up for hearing, the learned Additional Government Pleader submitted that on the complaint given by one Gangatharan, initially the respondent police registered a case in Crime No.50/2017 on 03.02.2017 under Section 174 Cr.P.C., in connection with the death of one Nagarajan. Later, during the course of investigation, it came to light that this petitioner was involved in the death of Nagarajan and therefore, an alteration report has been filed before the Judicial Magistrate, Manamadurai, altering the case in Crime No.50/2017 from 174 Cr.P.C. under Section 306 IPC. 4.In view of the above, the relief claimed by the petitioner cannot be granted. Hence, this petition is closed with liberty to the petitioner to work out her remedy in the manner known to law. No costs. Consequently connected Miscellaneous Petition is closed.
