ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 498(A), 494, 406, 420, 294(b), 323 and 1/3
506(i) IPC in Cr.No.09 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner and the defacto complainant are husband and wife. After marriage, the accused persons harassed the defacto complainant by demanding additional dowry. That apart, when the marriage between them is in existence, the petitioner married another woman. 3.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl.side) for the respondent submits that the investigation is yet to be completed.
5.It appears that the petitioner filed a petition before the Family Court, Trichy in HMOP.No.188 of 2018 and the same was ordered and maintenance was also ordered. Challenging the same, the defacto complainant filed an appeal in CMA.(MD)No.184 of 2022 before this Court and an order of interim stay was also granted by this Court. When the first marriage is in existence, the petitioner married another woman and till date, he has not paid any maintenance to the defacto complainant. 6.Considering the fact that petitioner has not paid maintenance amount as ordered by the Court below, this Court is not inclined to grant anticipatory bail to the 2/3
