Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioner's petition dated 20.02.2023 to reimburse Rs.2,70,697/- (Rupees Two Lakhs Seventy Thousand Six Hundred and Ninety Seven), that the expenses incurred by the Petitioner for his mother's treatment of COVID PNEUMONIA/COPD Critical Care in the Non-Network Hospital at Theni Medical Centre, Theni as per the G.O.Ms.Nos.280 and 281 dated 24.06.2020.

Heard Mr.V.R.G.Mohan, learned counsel appearing for the petitioner, Mr.J.Ashok, learned Additional Government Pleader appearing for R1 to R4 and Mr.C.Karthik, learned counsel appearing for R5.

2. The petitioner has filed this petition seeking to issue a Writ of Mandamus directing the respondents to consider his petition dated 2/6

20.02.2023 to reimburse the expenses to the tune of Rs.2,70,697/- incurred by him for his mother's treatment for Covid Pneumonia / Copd in the Non-Network Hospital at Theni Medical Centre, Theni as per the G.O.Ms.Nos.280 and 281, Finance (Salaries) Department, dated 24.06.2020.

3. Mr.J.Ashok, learned Additional Government Pleader appearing for the respondents 1 to 4, on instructions, submitted that the claim of the petitioner for reimbursement of medical expenses has been considered and the eligible amount of Rs.1,23,022/- has already been sanctioned by the fifth respondent Insurance Company and the same has also been credited to the petitioner's bank account.

4. If the petitioner is aggrieved due to his expenses for the remaining claim, he is at liberty to prefer an appeal before the State Level Empowering Committee.

5. In view of the same, the writ petition is disposed of with a 3/6

liberty to the petitioner to prefer an appeal before the State Level Empowering Committee within a period of two weeks from the date of receipt of a copy of this order and the State Level Empowering Committee shall consider the appeal, if any filed by the petitioner, within a period of four weeks thereon. No costs. Consequently, connected Miscellaneous Petition is closed.
