MR.RMS.SETHURAMAN, Additional Public Prosecutor on behalf of the 4th Respondent and the 1 TO 3 respodents not appearing either in person or by an advocate, the court made the following order:- This Petition has been filed to cancel the anticipatory bail granted to the respondents 1 to 3 by this Court in Crl.O.P(MD).No.2632 of 2023, dated 10.03.2023.
2. The learned counsel appearing for the petitioner submitted that the respondents 1 and 3 herein got extension and complied the order passed by this Court in Crl.O.P(MD).No.2632 of 2023 and went on bail. But, the 2nd respondent has not complied with the order passed by this Court and hence, seeking to cancellation of anticipatory bail granted to the petitioner / 2nd respondent herein.
3. The learned Additional Public Prosecutor would submit that the respondents 1 and 3 herein have complied with the order of this Court, but, the 2nd respondent has not complied the order passed by this Court.
4. Though the notice served on the respondents 1 to 3 and their names have been printed in the cause list no one has appeared.
5. Considering the submission made by both parties, with regard to the 2/4
respondents 1 and 3 viz., Justin Raj and Johnson @ Mani, I do not find any ground to cancel the anticipatory bail.
6. Since the 2nd respondent viz., Jayasingh has not complied the order of this Court passed in said Crl.O.P(MD).No. 2632 of 2023, the anticipatory bail granted to the petitioner in the said Crl.O.P is cancelled.
