Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records in connection with the impugned order in Na.Ka.No.1/C/2022 dated 09.07.2022 on the file of first respondent office transferring second respondent to the Nagercoil Government Arts and Science College overtaking the seniority 1/4

of petitioner and quash the same as illegal and irregular and direct the first respondent to post petitioner in the existing vacancy in the Physics Department of Nagercoil Government Arts and Science College. For Petitioner : Mr.S.Titus For R-1 : Mr.S.Shaji Bino, Special Government Pleader.

ORDER

Though the petitioner herein had challenged the order of transfer of the second respondent herein, dated 09.07.2022, the learned counsel for the petitioner submitted that he is not pressing for such a prayer to quash the order of transfer of the second respondent and that he would be satisfied, if the request of the petitioner for transfer is considered by the first respondent herein within a time frame.

According to the learned counsel for the petitioner, there is a vacancy at the Government Arts and Science College, Nagercoil in the post of Assistant Professor (Science), apart from the post to which the second respondent herein has been transferred. In this regard, the petitioner also claims to have given a request to the first respondent on 18.01.2022, which is pending. 2/4

In the light of the submissions made by the learned counsel for the petitioner, there shall be a direction to the first respondent herein to consider the petitioner's representation, dated 18.01.2022, on its own merits and pass appropriate orders in accordance with law, within a period of two (2) weeks from the date of receipt of a copy of this order.

4. This Writ Petition is ordered accordingly. There shall be no order as to costs.
