Prayer in Crl.MP(MD)No.329 of 2025;- Criminal Miscellanoues Petition filed under Section 528 of BNSS ,to modify the condition imposed by this Hon'ble Court that the appellant shall report before the Speial Court for Trial of Cases under SC/ST(POA) Act 1989,Erode daily at 10,30 am. Until further order in Crl A(MD)No.901/2024 datd 29/11/2024 in S.C.No.25/2022 on the file of the Learned Special Court for Trial of Cases under SC/ST/(POA)Act 1989,Thoothukudi.

Prayer in Crl.A(MD)No.901 of 2024;- Criminal Appeal filed under Section 14A(2) of SC/ST Act 1989 as amended by Act 14 of 2016 to call for the records relating to the order in Cr.M.P.No.809 of 2024 dated 06/08/2024 in S.C.No.25 of 2022 on the file of the Special Court for Trial of Cases under SC/ST(POA) Act 1989 Thoothukudi. And set aside the same and grant bail to the appellant.

ORDER:- This Criminal Miscellanoues Petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.K.Suyambulinga bharathi , Advocate for the Petitioner and of Mr.K.Gnanasekaran Government Advocate (Crl.Side), this Court made the following order:

This petition is filed to relax the condition which was imposed on the petitioner in Crl.M.P(MD)No.329 of 2025 dated 07.02.2025 in Crl.A(MD)No.9901 of 2024, by this Court.

2. The learned Government Advocate (Crl. Side) submitted that the petitioner has been complying with the condition regularly, without any default.

3. Considering the fact that the petitioner is complying the condition regularly and also in view of the reasons cited by the petitioner in the affidavit filed in support of this petition, I feel that the condition imposed on the petitioner can be relaxed.

4. Accordingly, the condition No.4 already imposed on the petitioners in Crl.M.P (MD)No.329 of 2025 dated 07.02.2025 in Crl.A(MD)No.9901 of 2024, by this Court is hereby modified as follows:

" The petitioner is directed to report before the Special Court for Trial of Cases under SC/ST (POA) Act, 1989, Thoothukudi, on the first working day of every month."

5. Other conditions shall hold good.
