Writ Petition is filed under Article 226 of the Constitution of India for issuance of a writ of Mandamus, directing the respondents 1 to 3 to form a committee for the celebration of Vinayagar Chathurthi or festival and Kumbabishekam in Sri Dharmamuneeswarar and Sri Nondi Muneeswarar temples in Vannichipattinam Village, Manamelkudi Taluk, Pudukottai District and also Mattu Pongal.

The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 1 to 3 to form a committee for the celebration of Vinayagar Chathurthi or festival and

Kumbabishekam in Sri Dharmamuneeswarar and Sri Nondi Muneeswarar temples in Vannichipattinam Village, Manamelkudi Taluk, Pudukottai District and also Mattu Pongal.

2.Mr.D.Muruganandham, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition itself is taken up for final disposal.

3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.

4.The learned counsel appearing for the petitioner would submit that the grievance of the petitioner is that the respondents 4 to 7 are collecting money illegally during the festival without the concurrence of the villagers and without forming any festival committee. Therefore, the petitioner has sent a representation to the respondents 1 to 3 to form a committee for the celebration of the festival. However, the said representation has not been considered so far and hence, the petitioner is before this Court with this petition.

5. The method/manner of celebration is a matter, which lies within the person, who seeks to celebrate. It is for the individual to take a decision as to whether to part with the money or not to part with the money, and for which, there cannot be a direction to the respondents 1 to 3 to form a special committee. Accordingly, the writ petition fails and the same is dismissed. No costs. Consequently connected Miscellaneous Petition is closed.
