Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing respondents 1 and 2 to consider the representation dated 06.05.2026 and to take preventive measures for curbing violence imminent in the ensuing temple functions on 25th, 26th, and 27th of May, 2026 by providing police protection to every event listed in the agenda of the temple functions on all the 3 days of the temple functions. ORDER
The present petition has been filed by the Administrative Committee of a temple, seeking a direction to the Police Officials to provide police protection for conducting the temple festival on 25.05.2026, 26.05.2026 and 27.05.2026. 2.In order to conduct the said function, the Administrative Committee has given a request to the respondent police on 06.05.2026. Since there is no response, the present writ petition has been filed. 2/6
3.One Mr.R.Sivanesan Nadar had filed W.P.Crl.(MD) No.2276 of 2026 before this Court, seeking a direction as against the present petitioners/Administrative Committee for initiating action against them for committing excommunication and refusing to collect 'vari' (tax) from them. The said Sivanesan Nadar had also prayed that he and his family members should be permitted to participate in the temple festival. 4.This Court, by an order, dated 22.04.2026, had directed the Inspector of Police, Tiruchendur Taluk Police Station, Thoothukudi District, to facilitate the private respondents in accepting kudiwari from Sivanesan Nadar and to take necessary steps to ensure Sivanesan Nadar's participation in the temple festival. Alleging violation of the orders, the said Sivanesan Nadar had filed a contempt petition in Cont.P.(MD) No.1615 of 2026.
According to the learned counsel appearing for the contempt petitioner, they have not collected tax as directed by this Court and they have not permitted the said Sivanesan Nadar and his family members to participate in the temple festival. 5.The learned counsel appearing for the petitioners herein, on instructions, submits that the petitioners would be permitted to participate in the temple festival.
will make his submissions in Cont.P.(MD) No.1615 of 2026. 6.In view of the aforesaid facts, this Court is inclined to pass the following directions:- a) The fourth respondent is directed to grant permission and provide police protection for conducting the temple festival on 25.05.2026, 26.05.2026 and 27.05.2026 to the petitioner Administrative Committee. b) The petitioner Administrative Committee is directed to permit Mr.R.Sivanesan Nadar and his family members to participate in the temple festival, namely, Sri Muthuramman Temple situated at Veerappa Nadar Kudiruppu, Tiruchendur Taluk, Thoothukudi District. c) As far as the rights of the petitioners to pay taxes are concerned, the same shall be left open to be decided in Cont.P.(MD) No.1615 of 2026. 7.With the aforesaid directions, the Writ Petition stands disposed of. No costs.
