PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the 1st, 5th and 6th Respondent herein to allocate the Land to the school survey No. 375 conduct a detailed enquiry into the implementation of the school in so far as Kirani village panchayat is concerned and consequently to take appropriate action in accordance with law from the 7th Respondent by considering his representation dated 15.10.2021.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the 1st, 5th and 6th Respondent herein to allocate the Land to the school survey No. 375 conduct a detailed enquiry into the implementation of the school in so far as Kirani village panchayat is concerned and consequently to take appropriate action in accordance with law from the 7th Respondent by considering his representation dated 15.10.2021.

2. The brief facts, as stated in the affidavit, are that the land originally belonged to Pandimathi. The 7th respondent is the power of attorney for Pandimathi. The land was laid out, and a portion was allocated for a school. However, despite the allocation, the portion has not been transferred to the school, and the school has not been constructed.

3. The writ petitioner has not stated whether it is an approved layout or not. Moreover, the approval authority is the County Town Planning. Therefore, there is no possibility of modifying the approved layout.

4. In view of the above, the first respondent/District Collector is directed to consider the petitioner's representation, dated 15.10.2021, and pass orders within a period of 12 weeks from the date of receipt of a copy of this order.

5. With the above observations and directions, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed.
