Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records in pursuant to the impugned orders passed by the 1st respondent in his proceedings No. Se.Mu.Na.Ka. No.700/A1/2025, dated 27.05.2025 and quash the same and consequently direct the respondents to reinstate the petitioner in service as Anganwadi Worker in Pilar Centre, Kallal 1/6

Block, Sivagangai District with all attendant and monetary benefits and by treating the period of suspension as duty with in a stipulated time may be fixed by this Court.

O R D E R

The writ petition has been filed challenging the order of suspension dated 27.05.2025 issued by the first respondent and to seek a direction to the respondents to reinstate the petitioner in service as an Anganwadi Worker at the Pillar Centre, Kallal Block, Sivagangai District, along with all attendant and monetary benefits, by treating the suspension period as duty.

2. Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The petitioner, who is presently serving as the District Secretary of the Tamil Nadu Anganwadi Employees and Assistants 2/6

Association, asserts that he was placed under suspension by the first respondent through an order dated 27.05.2025, citing his absence during the District Collector's inspection conducted on 07.05.2025. The petitioner states that he was on medical leave for undergoing surgery at the time. He further contends that the impugned suspension order was issued in violation of the principles of natural justice, as it was passed 20 days after the alleged incident on 07.05.2025. Aggrieved by the said order, the petitioner has filed the present writ petition.

4. On the other hand, the learned Special Government Pleader appearing on behalf of the respondents would submit that if the petitioner submits an explanation before the competent authorities, the same will be duly considered and appropriate orders will be passed.

In the light of the above submission, this Court directs the petitioner to submit her explanation, along with the grounds raised in this writ petition, within a period of fifteen days from the date of receipt of a copy of this order. Upon receipt of such explanation, the respondents shall consider the same and pass appropriate orders on merits and in accordance with law, within a period of two months thereafter. 3/6

6. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. Consequently, the connected miscellaneous petitions are closed. 18.06.2025 Index : Yes / No Internet : Yes / No PKN 4/6
