ORDER
The present writ petition has been filed by a student of an aided institution seeking a mandamus directing the respondents 1 to 3 to initiate appropriate action under Section 14-A of the Tamil Nadu Recognised Private Colleges (Regulation) Act on the allegation of illegal collection of excess fee from the students.
2.The third respondent has filed a counter. Paragraph No.13 is extracted as follows:
"13.I respectfully submit that the writ petitioner, as a third year student, he is not concentrating in his studies and not taking efforts to complete his degree and also, without correcting the erroneous attitude of the writ petitioner, he is finding false against third respondent without knowing the efforts taken by the third respondent. Without concentrating on his studies, he is acting as puppetry on the hands of some people who is guiding him wrong. Even though the writ petitioner filing the writ petition against third respondent, that he is also having conspiracy with the excess collection of fee. But, the third respondent he himself conducted enquiry regarding this issue and sent proposals to the second 3/7
respondent and to took efforst to refund the students money and also sent proposal to appoint the special officer for this college, and also that he insisted the writ petitioner to concentrate on his studies and further he himself intimated the writ petitioner that he will proceed further on this issue. Hence, the Hon'ble High Court consider the writ petitioner as a student and kindly advice the writ petitioner to give concentration on study and not to involve in the issues of management."
3.The averments in Paragraph No.13 would clearly reveal that the third respondent is already initiating action on the complaint lodged by the writ petitioner.
4.The learned counsel for the petitioner submits that it would be suffice to give a direction to the third respondent to complete the enquiry. 5.In view of the above said deliberations, the writ petition is disposed of with a direction to the third respondent to complete the enquiry and pass orders within a period of eight weeks from the date of receipt of a copy of this order. No costs.
