PRAYER: Writ Petition is filed under Article 226 of Constitution of India for issuance of Writ of Mandamus, directing the respondents to provide police protection to the petitioner to carry out his peaceful and smooth running of M/s.Jeppiaar Fishing Harbor, Muttom Private Limited, Muttom, Kanniyakumari District by considering the petitioner's representation dated on 29.04.2023.

ORDER

This writ petition has been filed to direct the respondents to provide police protection to the petitioner to carry out his peaceful and smooth running of M/s.Jeppiaar Fishing Harbor, Muttom Private Limited, Muttom, Kanniyakumari District by considering the petitioner's representation dated on 29.04.2023.

2.Mr.B.Nambiselvan, learned Additional Public Prosecutor takes notice for the respondents.

3.It is submitted that on the basis of the some issue between the 2/5

brother and sister over the Management of the above said company namely M/s.Jepiaar Fishing Harbor, trouble has arisen between them. The Manager of the above said Company namely Mr.Karthi has given the complaint against one Sheela Jeppiaar, which was registered in Crime No.83 of 2023 on 16.06.2023. Seeking Police protection, this petitioner has given a representation to the respondent police. Since the same was not considered till now, the petitioner has come forward with the petition. 4.In the above said representation that was made by the petitioner, it has been admitted by them that in respect of the above said issue between them, there is a proceeding pending before the National Company Law Tribunal, Division Bench, Chennai, in C.P./131(CHE)/2021. The grievance of the petitioner is that even before the disposal of the above said petition, the trouble has been made by the counter parties in taking the above said business. Over which only the above said case has been registered and representation was also made.

5.Let the above said representation dated 29.04.2023, made by the petitioner be enquired and disposed by the respondent police by summoning the petitioner as well as the counter parties. Let the above said process be 3/5

done, within a week from the date of appearance of parties. Depending upon the outcome of the enquiry, further action may be taken either by the authority or by the parties concerned, if so aggrieved. 6.With the above said directions, this writ petition stands disposed of. No costs.
