O R D E R

The petitioner seeks for a Mandamus directing the respondent to consider the petitioner's application for issuance of birth certificate to the petitioner's son, namely Vignesh based on the representation dated 03.12.2016.

It appears that the request of the petitioner was not considered by the respondents on the reason that the birth was not registered immediately after the birth.

The learned counsel appearing for the respondent submitted that in view of the recent communication issued by the Director of Public Health and Preventive Medicine and Chief Registrar of Birth and Death, Tamil Nadu, dated 26.12.2016 intimating the amendment to Rule 9(3) of the Tamil Nadu Registration of Birth and Deaths Rules, 2000, the petitioner can approach the concerned Revenue Divisional Officer to get the birth registered even if the birth was not registered within one year of its occurrence.

Recording the abovesaid submission, this writ petition is disposed of by giving liberty to the petitioner to approach the concerned Revenue Divisional Officer and make a request https://hcservices.ecourts.gov.in/hcservices/

accordingly. If any such application is filed, the concerned Revenue Official shall consider the same and pass appropriate orders on merits and in accordance with law without loss of further time. No costs.
