PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the impugned order under proceeding No. TNSTC/ KUMB/TRICHY/ O.N/ D4/ 3299/2022 dated 17.05.2023 passed by the 1st respondent, confirming the orders passed by the 2nd respondent under proceeding No. TNSTC/ TRY/ DS-958/ 1/5

MJAO2/ D4/ 3299/ 2022 dated 19.10.2022 and to quash the same as illegal and further direct the respondents to fix the pay scale by applying the eligible increments.

O R D E R

The petitioner is working as a driver in the respondent Transport Corporation. He was issued with a charge memo on 01.06.2022 that he has caused damage to the transport Corporation bus and he was also imposed with a punishment of stoppage of increment for a period of one year with cumulative effective. As against the order of punishment, the petitioner has filed this writ petition in the year 2023.

2.Today(17.12.2025), when this writ petition is taken up for hearing, the learned Standing Counsel appearing for the respondent Corporation has raised preliminary objections that the petitioner is having an effective remedy before the Labour Court by raising a dispute under Section 2(k) of the Industrial Disputes Act. 2/5

He further submits that since disputed questions of facts are also involved, it needs to be adjudicated only before the Labour Court and not before this Court.

3.The learned counsel for the petitioner submits that the petitioner's objections have not been considered by the authority and not even his objections have been recorded in the order of punishment. Therefore, the petitioner has approached this Court. 4.Since this petitioner is having an effective remedy before the Labour Court, this writ petition is closed with liberty to this petitioner to workout his remedy before the Labour Court by raising an industrial dispute. No costs. Consequently, connected Miscellaneous Petition is also closed.
