The Second Appeal is directed against the judgment and decree dated 21.02.2023 passed in A.S.No.77 of 2022 on the file Additional District Court 1/4

(FTC) Tenkasi, confirming the judgment and decree of the trial Court, dated 27.06.2022 passed in O.S.No.39 of 2019 on the file of the Additional Subordinate Court, Tenkasi.

2. When the matter is taken up for hearing today, the learned counsel appearing for the appellant would submit that they have deposited the amount before the Executing Court, since the matter was settled amicably between the parties out of the Court. Hence, he seeks permission of this Court to withdraw this appeal and filed a memo to that effect and also made an endorsement.
