2.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that on the basis of the complaint given by the third respondent enquiry is undertaken and it is pending before the respondent police in C.S.R.No.284 of 2023. Reading of the complaint shows that when the defacto complainant demanded back the loan amount form the accused, which was given to him as loan, the accused person alleged to have abused him.
3.Since it is a money transaction, the respondent police may close the complaint given by the defacto complainant by advising the parties to workout their remedies through appropriate civil process. 4.With the above said directions, this criminal original petition stands disposed of.
