PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of writ of mandamus directing the respondents herein to take appropriate action to issue a certificate of practice to the petitioner, which she had successfully passed in the All India Bar Examination held at 8th January-2012 at Bangalore as I stated in her requisition letter, dated 13.07.2016.

[Order of the Court was made by M.SATHYANARAYANAN, J.] With the consent of both sides, this writ petition is taken up for final hearing.

2. The grievance expressed by the petitioner is that though she has passed Law Degree and got enrolled as an Advocate before the Bar Council of Tamil Nadu and Puducherry on 07.08.2011 and also passed the All India Bar Examination conducted on 08.01.2012, till date, the respondents have not issued Certificate of Practice to her.

3. The learned counsel for the petitioner has drawn the attention of this Court to the typed set of papers and submitted that the Bar Council of India has declared the petitioner that she https://hcservices.ecourts.gov.in/hcservices/

has passed the All India Bar Examination held on 08.01.2012 and therefore there may not be any impediment on the part of the second respondent to issue Certificate of Practice to the petitioner and therefore prays for orders.

Per contra, Mr.M.Subash Babu, learned counsel appearing for the respondents, submitted that necessary instructions will be given to the second respondent to issue Certificate of Practice to the petitioner as expeditiously as possible and also drawn the attention of this Court to the All India Bar Examination Rules, 2010 and submitted that as per Rule 11(2) of the said Rules, the Certificate of Practice shall be issued by the Bar Council of India under the signature of the Chairman, Bar Council of India and therefore there is a delay and undertook to get the same issued to the petitioner at an early date.

In the light of the submissions made coupled with the above facts and circumstances, this Court directs the respondents to take necessary steps to issue Certificate of Practice to the petitioner as expeditiously as possible, preferably within a period of three weeks from the date of receipt of a copy of this Order.
