Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st respondent to remove the illegal construction made by the 5th to 8th respondents at Survey No.391/3 (Water Body) of Nadumandalam Village, Dindigul District and to take action against the 3rd, 5th to 8th respondents for cutting government trees without permission and encroaching water body and covering the above illegal acts on the basis of representation dated 04.11.2024 made by the writ petitioner. ORDER

The petitioner is the resident of Nadumandalam Village. He alleges that there are encroachments in S.No.391/3. Since action to 2/6

remove the encroachments was not taken, this writ petition came to be filed.

2.When the matter was taken up for hearing, the learned Government Advocate confirmed that S.No.391/3 is a water body and that they have already issued notices for removing the encroachments. The encroachers to respond to the notices issued by the authorities. The authorities are directed to take the process to its logical conclusion. It is made clear that no new construction in a water body shall be permitted. Allegations have been made regarding illegal felling of trees. The jurisdictional police shall register an FIR. The District Collector shall also look into the complaint of the petitioner and take follow up action. 3.This writ petition is allowed on these terms. No costs.
