ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 126(2), 296(b), 118(1) and 351(3) of BNS, 2023 in Crime No.223 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that on 07.05.2025, while the de-facto complainant was riding his two-wheeler, the petitioner and the other accused persons, under the influence of alcohol, rammed their car into him, causing him to fall on the ground. Thereafter, the petitioner and the other accused persons attacked the de-facto complainant with an iron rod and threatened him with dire consequences. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person, and has not committed any offence as alleged by the prosecution. He has been falsely implicated in this case. Hence, he seeks anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) submitted that there are totally five accused persons in this case and the petitioner has been arrayed as A1. A4 and A5 have been arrested and subsequently released on bail. A2 has been arrested and is still in custody. The injured sustained a hand injury and was 2/4

admitted in the hospital for approximately 20 days. Hence, he opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case, and taking note of the fact that A2 is still in custody, and considering the specific overt act against the petitioner, and also considering the fact that the injured was admitted in the hospital for about 20 days, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.
