ORDER

The petitioner has approached this Court seeking a direction to the respondent authorities to restore electricity supply to the petitioner's agricultural service connection pertaining to the lands comprised in Survey Nos.16/4A-2 and 16/4B-2 situated at Muthammalpuram Village, V.K. Pudur Taluk, Tenkasi District.

2. The petitioner was originally sanctioned an electricity service connection under the agricultural tariff category. According to the respondents, the petitioner had erected an electric fence around the agricultural land and had unlawfully tapped electricity from the main supply line, thereby misusing the service connection. On the basis of the 2/6

said allegation, the respondents disconnected the electricity supply to the petitioner's service connection. However, it is not in dispute that no prior notice was issued to the petitioner before effecting the disconnection.

3. Considering the facts and circumstances of the case, and particularly the absence of any prior notice before disconnection of the service connection, this Writ Petition is disposed of with a direction to the respondents to restore electricity supply to the petitioner's agricultural service connection within a period of one week from the date of receipt of a copy of this order.

4. The petitioner shall file an undertaking before the competent authority stating that he shall not, in future, misuse electricity or draw power illegally from the main supply line and that he shall strictly adhere to the provisions governing the use of the service connection.

5. With the above direction, the Writ Petition stands disposed of. 3/6

6. There shall be no order as to costs.
