Mr.G.Anto Prince, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.396/2024 on the file of the respondent police.

ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 365, 294(b), 323, 324 and 506(ii) of IPC, in Cr.No.396 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that due to money dispute the parties, the petitioner and other accused said to have abused the defacto complainant in filthy language and also assaulted him with iron rod and caused injury. Hence, the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate(Crl.Side) would submit that totally four accused and the petitioner is arrayed as A1 and the petitioner is having 13 previous cases and he is a history sheeted rowdy and the investigation is pending. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5. The learned counsel for the intervenor / defacto complainant submits that if the petitioner was released on anticipatory bail, there is every chance to threaten the defacto complainant and hence, prayed for dismissal of the petition.

6. Considering the facts and circumstances of the case and also considering the 2/3

gravity of the offence and the bad antecedents of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner, at present.

7. Accordingly, this Petition is dismissed.
