ORDER : The Court made the following order :- The petitioner/A1, who was arrested and remanded to judicial custody on 05.06.2024 for the offences punishable under Section 174 of Cr.P.C. @ - in crime No.281 of 2024 on the file of the respondent police, seeks bail. 2.The case of the prosecution is that due to the torture of the petitioner by 1/3
demanding loan, the wife and daughter of the defacto complainant were hanging themselves and died. Hence, he lodged a complaint before the respondent police and the case has been registered under Section 174 of Cr.P.C. Subsequently, the case was altered into Sections 306 I.P.C r/w. Section 4 of Tamil Nadu Prohibition of Charging Exorbitant Interest Act. Hence, the offence was altered. 3.The learned counsel for the petitioner would submit that the petitioner is innocent and she has been falsely implicated in this case. He would further submit that the petitioner is in judicial custody from 05.06.2024, hence she may be released on bail.
4.The learned Government Advocate (Crl. side) would submit that totally three accused in this case and the petitioner is arrayed as A3 and the investigation is yet to be completed. Hence, he strongly opposed to grant bail. 5.Considering the facts and circumstances of the case and also considering the gravity of the offence, this Court is not inclined to grant bail to the petitioner. 6.Accordingly, this Criminal Original Petition is dismissed. sd/- 09/07/2024 / TRUE COPY / /07/2024 Sub-Assistant Registrar ( C.S.
