ORDER
The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the refusal check slip dated 02.06.2025 and consequently to direct the third respondent to register the sale deed dated 28.03.2025.
2. Through the impugned order, the respondent have stated that there is an objection by the fourth respondent. The objection of the fourth respondent is that there is already a parallel document was registered as early as in the year 2004. Therefore, if the petitioner's sale deed is registered then it would amount to a double entry.
3. The issue of double entry has already been considered by this Court in the case of T.Senthilvel Vs. The District Registrar and others in W.P.(MD)No. 22114 of 2024 dated 17.10.2024, wherein, the Hon'ble Single Judge held that 2/5
based on double entry, the respondent cannot refuse registration.
4. Therefore, following the said judgment, the impugned order is quashed. The third respondent is directed to register the sale deed dated 28.03.2025, within a period of four (4) weeks from the date of receipt of a copy of this order. It is open to the aggrieved parties to work out their remedies before the competent Civil Court in accordance with law.
5. With the above said directions, this Writ Petition is disposed of. There shall be no order as to costs.
