For Respondent : Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- For Anticipatory Bail in Crime No.14 of 2023 on the file of the Respondent Police.

ORDER : The Court made the following order :- The petitioners/Accused who apprehend arrest at the hands of the respondent police for the offences punishable under sections 294(b),323,506(ii) of I.P.C and section 7,8,11(1),11(4),12 of POCSO Act,2012 in Crime No. 14 of 2023 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the victim is aged about 13 years and A1 often teaser her and made comments using filthy language and when the same was questioned, the petitioners herein attacked the father of the victim, hence the case.

3. Heard both side and perused the materials available on record including the First Information Report.

4. It is seen from the First Information Report that there are totally four accused in this case and the petitioners herein are https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.11113 of 2023 arrayed as A1 to A4. The allegation is that the victim girl is aged about 13 years and she was sexually tortured by the first accused. He also hugged and kissed her. When it was informed to the defacto complainant and when he questioned the same, the petitioners herein beaten them and also threatened with dire consequences and also abused him in filthy language and threatened to commit rape on the victim girl. So far first accused not yet arrested. The accused persons have committed very serious and heinous offence as against the minor victim hence this Court is not inclined to grant anticipatory bail to the petitioners.
