ORDER

This petition has been filed seeking a direction to the second respondent to cancel the look out circular issued against the petitioner.

2.The learned Additional Public Prosecutor appearing for the respondents 2 to 4 submits that the petitioner herein is an accused in Cr.No.24 of 2023. The respondent Police has also filed final report, 2/6

which is taken on file in C.C.No.926 of 2023 by the learned Judicial Magistrate No.I, Nagercoil. The respondent Police has got an information that the petitioner is attempting to abscond and flee away from justice and therefore, they have issued look out circular. In the event, if the petitioner gives adequate surety to ensure that he would be available for trial, they are ready to recall the look out circular.

3.The learned counsel appearing for the petitioner submits that the petitioner got a job opportunity at Dubai and in view of the look out circular, he is not in a position to go to Dubai. Further, he submits that the petitioner is prepared to provide adequate surety before the learned Judicial Magistrate No.I, Nagercoil. 4.Considering the submissions made by the learned counsel appearing for the petitioner, the petitioner is directed to file necessary application before the learned Judicial Magistrate No.I, 3/6

Nagercoil. In the event, if the petitioner satisfies with sufficient surety before the learned Magistrate that he will be available for trial, the learned Magistrate shall pass necessary orders to the Superintendent of Police, Kanniyakumari District that the petitioner has already furnished adequate surety and look out circular may be recalled. On receipt of such direction from the learned Magistrate, the Superintendent of Police, Kanniyakumari District is directed to recall the look out circular.

5.With the above directions, this writ petition stands disposed of. No costs.
