Mr.R.M.Anbunithi, Additional Public Prosecutor PETITION FOR ANTICIPATORY BAIL UNDER SEC 482 of BNSS PRAYER :- For Anticipatory Bail in Crime No.382 of 2022 on the file of the respondent police.
ORDER : The Court made the following order :- The petitioner/Accused, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 8(c) r/w Section 20(b)(ii)(c) of Narcotic Drugs & Psychotropic Substances Act, 1985, in Crime No.382 of 2022, seeks anticipatory bail.
2.The case of the prosecution is that the petitioner was found in illegal possession of 22 kg of Ganja. Hence, the complaint. 1/3
3.The learned counsel for the petitioner would submit that the petitioner is an innocent and she has been falsely implicated in this case. He would further submit that this is the second anticipatory bail petition. Earlier petition filed by the petitioner in Crl.OP(MD)No.9071 of 2023 was dismissed by this Court on 14.06.2023. Hence, he prays for anticipatory bail.
4.The learned Additional Public Prosecutor appearing for the respondent police would submit that the investigation is still pending. The contraband recovered from the petitioner comes under the commercial quantity. Apart from that, the petitioner is having 2 previous cases in similar nature. Hence, he vehemently, opposed to grant anticipatory bail to the petitioner.
5.Considering the facts that the present case is relating to NDPS Act and also considering the quantity of the contraband involved in this case is 22 kg, I am of the view that this is not a fit case for grant of anticipatory bail. 6.Accordingly, this Criminal Original Petition stands dismissed. sd/- 05/08/2024 / TRUE COPY / /08/2024 Sub-Assistant Registrar (C.S.
