ORDER
This writ petition has been filed by the petitioner seeking the issuance of a Writ of Mandamus directing the respondent to consider and dispose of the petitioner's representation taken on file in case register as Serial No.127 pending on the file of the Respondent on the basis of Circular No.67 issued by the Inspector General of Registration.
2.According to the petitioner, he had purchased the property comprised in Plot No.76 situated at Sakthi Nagar, Thekkattur Village, Arimalam Panchayat Union, Pudukkottai District from one Lalitha through her power agent, namely, K.Kaliyamoorthy by way of registered sale deed in Doc.No.3475/2009. It is appears that one Sundaragopalan @ Sankar belongs to the same area sold the very same property to some other person, namely, Palani Gounder by using forged power of attorney deed, for which, a case was also registered in Crime No.55 of 2013 before the District Crime Branch, Pudukkottai, which is still pending. petitioner sent a representation to the respondent on 17.03.2015 to cancel the above-said fraudulent transaction taken place. Till date, no action has been taken on the said representation, the petitioner has come before this Court with the relief as stated supra.
3. The learned counsel appearing for the petitioner would submit that it would suffice if the representation of the petitioner is disposed of, by the respondent, on merits and in accordance with law within the time stipulated by this Court.
4. The learned Additional Government Pleader appearing for the respondent would submit that the representation of the petitioner will be considered in accordance with law.
5. In view of the limited scope of the prayer, without going into the merits of the claim made by the petitioner in this Writ Petition, the respondent is directed to pass appropriate orders on the representation of the petitioner, dated 17.03.2015, on merits and in accordance with law, after giving notice to the interested parties, if any, within a period of four months from the date of receipt of a copy of this order.
With the above direction, this Writ Petition stands disposed of. No costs.
