Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Mandamus, directing the first respondent to dispose of the petitioner's Second Appeal dated 10.07.2024 filed under Section 19(3) of the Right to Information Act, 2005 and further directing the respondents 3 to 5 to disclose and furnish appropriate information as requested in his RTI Application dated 16.04.2024. ORDER

The petitioner herein seeks a direction to the first respondent to dispose of his second appeal dated 10.07.2024 filed under Section 19(3) of the Right to Information Act, 2005.

2.Heard the arguments of Mr.B.Vinothkumar, learned counsel appearing for the petitioner, Mr.Raguvaran Gopalan, learned Government

Advocate appearing for the first respondent, Mr.D.S.Nedunchezian, learned Government Advocate appearing for the respondents 2 and 3 and Mr.J.K.Jayaselan, learned Government Advocte appearing for the respondents 4 and 5. Since no adverse order is passed against the respondents 3 and 4, notice to the respondents 3 and 4 is dispensed with. 3.By consent of both sides, this Writ Petition is taken up for final disposal at the admission stage itself.

4.It is the case of the petitioner that he submitted an application before the fourth respondent seeking certain information pertaining to the Mahatma Gandhi National Rural Employees Guarantee Scheme implemented by the fifth respondent. The fourth respondent directed the fifth respondent to furnish all information by his order dated 06.05.2025. Even thereafter, the fifth respondent has not furnished the information. Therefore, the petitioner submitted an appeal before the third respondent. The third respondent also directed the respondents 4 and 5 to furnish the information sought for by the petitioner and the same has not been furnished. Hence, the petitioner filed a second appeal before the first

respondent on 10.07.2024 under 19(3) of the Right to Information Act Act. The said second appeal has not been considered till date. Therefore, the petitioner has come before this Court.

5.The learned Government Advocate appearing for the first respondent would submit that the second appeal filed by the petitioner will be disposed of in accordance with law within the time stipulated by this Court.

6. In view of the same, without expressing any opinion on the merits of the matter, the first respondent is directed to consider the second appeal filed by the petitioner dated 10.07.2024 and pass final orders on its own merits within a period of eight weeks from the date of receipt of a copy of this order, after affording an opportunity to the petitioner and other interested parties. Accordingly, this Writ Petition is disposed of. No costs.
