ORDER : The Court Made the following order :- The petitioner is in judicial custody since 27.07.2018 for the offences punishable under Section 420 I.P.C and Section 66(D) of Information Technology Act, 2000, in Crime No.33 of 2018. He seeks bail.
2.The case of the prosecution is that the petitioner joining hands with other accused by contacting the customers claimed themselves as a official of the financial firm and obtained the password of the various customers. Thereby accessed the bank account and withdrew the money from various accounts of the customers. Hence, the case has been registered.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent. He did not commit any offence as alleged by the prosecution. Further, he submitted that the petitioner is in incarceration from 27.07.2018 onwards. Hence, he prays for bail. 4.The learned Additional Public Prosecutor appearing for the respondent submitted that the investigation is pending. https://hcservices.ecourts.gov.in/hcservices/
5.Considering the above facts and circumstances and also considering the period of incarceration of the petitioner, this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail subject to the following conditions:
(i) the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Tirunelveli.
(ii)the petitioner shall appear before the respondent police as and when required for interrogation.
