PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to dispose of the case in C.C.No.3 of 2016 on the file of the Learned Judicial Magistrate, Thirumangalam, Madurai District as expeditiously as possible within a time frame. For Petitioner : Mr.N.Balasubramanian For Respondents : Mr.B.Nambiselvan Additional Public Prosecutor O RDER This petition has been filed seeking direction to the Learned Judicial Magistrate, Thirumangalam, Madurai District in C.C.No.3 of 2016 to dispose the case within in stipulated time by this Court. 2.The petitioner who is the third accused in Crime No.146 of 2010 1/4

on the file of the respondent police, facing trial before the trial before the trial Court in C.C.No.3 of 2016, for the offences punishable under Sections 294(b), 342, 427, 452, 379, 506(i) and 109 of IPC. The grievance of the petitioner is that though the case is of the year 2016, so far no progress in this case.

3.The learned Additional Public Prosecutor would submit that so far totally 10 witnesses are there. Non bailable Warrant is pending against some of the accused persons.

4.In view of the submissions made by the learned Additional Public Prosecutor, there shall be direction to the learned Judicial Magistrate, Thirumangalam, Madurai District, to split up the case in respect of the accused persons, who are regularly appearing, since warrant is stated to be pending against some of the accused persons , some of the accused persons were reported to be dead and complete the trial process. The trial Court shall do the entire exercise, within a period of five months from the date of receipt of a copy of this order. 2/4

5.With the above said directions, this criminal original petition stands disposed of.
