ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the offence punishable under Section 379 of I.P.C. @ 392 and r/w Section 34 of IPC in Crime No.377 of 2017, on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that during conduct of vehicle check up on 26.02.2018 at about 09.00 a.m in the place of Thirupparankundram Nelaiyur junction. At that time three persons tried to escape from that place, the police officers suddenly captured the petitioner/accused and two other accused. The petitioner/accused had voluntarily given a confession statement. The petitioner/accused was arrested and remanded in judicial custody on 26.02.2018.

3. The learned counsel appearing for the petitioner would submit that the petitioner already arrested in Crime No.377 of 2017 and thereby released on bail, on condition that he shall report before the respondent police daily at 10.30 a.m. He would further submit that due to illness, the petitioner did not comply the condition imposed by the trial Court. Therefore, he apprehends arrest.

4. The learned Additional Public Prosecutor appearing for the

respondent would submit that charge sheet has been laid in C.C.No.221 of 2018, pending before the learned Judicial Magistrate No.VI, Madurai.

5.Considering the facts and circumstances, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.VI, Madurai, and on his executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties, each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the trial Court daily at 10.30 a.m until further orders. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.

6.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
