... 2nd Respondent PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the 1st Respondent to transfer the investigation in case file in Crime No.72 of 2023 on the file of the 1st Respondent to the some other competent police officials under his jurisdiction with suitable direction to conduct impartial investigation reinvestigate case and to file final report under relevant penal proceedings against the accused persons within the reasonable time as directed by this Hon'ble Court and thus render justice.

O RDER This criminal original petition has been filed seeking direction to the 1st Respondent to transfer the investigation in case file in Crime No. 72 of 2023 on the file of the 1st Respondent to the some other competent police officials under his jurisdiction with suitable direction to conduct impartial investigation reinvestigate case and to file final report under relevant penal proceedings against the accused persons within the reasonable time as directed by this Court.
2.The learned Additional Public Prosecutor would submit that investigation has been completed and final report is also made ready on 23.05.2023 and it will be present before the concerned Court within a period of short time.
3.The grievance of the petitioner is that the penal provision has been mentioned as only 506(ii) of IPC. The investigation has not been done in proper manner and proper penal provisions have not been added by the respondent police. Whatever may be, since the investigation has been completed, the prayer sought for in this petition has become infructuous. The petitioner is granted liberty to workout his remedy through appropriate proceedings, if so aggrieved by the contents of the 2/4
final report.
4.With the above said liberty, this criminal original petition stands dismissed as infructuous.
