PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C, to direct the Additional Mahila Court (Magistrate Level), Nagercoil, to dispose of the criminal case in CC No.40 of 2018 pending on the file of Additional Mahila Court (Magistrate Level), Nagercoil within a period of 3 months.

ORDER

This petition is filed seeking a direction to the learned Additional Mahila Judge (Magistrate Level), Nagercoil to expedite the trial in C.C.No.40 of 2018 within the time stipulated by this Court.

2.The petitioner has been arrayed as 5th accused in the aforesaid case, which was registered for the offences punishable under Sections 147, 427, 447, 323 and 506(ii) of IPC and Section 4 of Tamil Nadu Prevention of Harassment of Women Act. 3.Now the grievance of the petitioner is that even though the case has been registered in 2013, still it is pending without any progress. It was also taken on file in 2018 also. 4.The learned Additional Public Prosecutor (Crl.side) appearing for the respondent would submit that now the case has been posted to 08.10.2021 for examining the witnesses. 5.Considering the oldness of the matter, there shall be a direction to the learned Additional Mahila Judge (Magistrate https://hcservices.ecourts.gov.in/hcservices/ 1/2

Crl.O.P.(MD)No.13053 of 2021 Level), Nagercoil, to expedite the trial and dispose of the matter within a period of 6 months from the date of receipt of a copy of this order.

6.After the disposal of the same, compliance report must be submitted to the Registry.
