O R D E R
The writ petition has been filed for issuance of a Writ of Mandamus, directing the respondents 2 and 3 herein to grant permission to the petitioner to use Speaker Box and Drum set on the occasion of his brother's marriage to be solemnized on 21.08.2016 at Perumalkovilpatti @ Anthoniyarpuram, Ambathurai, via Athoor Taluk, Dindigul District.
2.Mr.D.Muruganandam, learned Additional Government Pleader, takes notice for the respondents. By consent, the writ petition is taken up for final disposal at the stage of admission itself.
3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents.
4.The learned counsel appearing for the petitioner would submit that on 16.08.2016 the petitioner had sent a representation to the respondents seeking permission to use Speaker Box and Drum set on the occasion of his brother's marriage to be solemnized on 21.08.2016 and that as there was no response to the same, he has come up with this petition.
5.The learned Additional Government Pleader appearing for the respondents, on instructions, would submit that in view of the peculiar circumstances prevailing in that area, the permission for using speaker box and drum set is necessary. However, he would submit that the 3rd respondent did not receive representation of the petitioner dated 16.08.2016.
6.This Court is of the view that in respect of private marriage functions, permission of the respondents for using Speaker Box and Drum set is not at all necessary. However, considering the above submission of the learned Additional Public Prosecutor, the petitioner is directed to make a fresh representation to the third respondent police and on such representation being given, the third respondent shall consider the same and pass appropriate orders on merits and in accordance with law forthwith, as the function is scheduled to be held on 21.08.2016.
7. With the above direction, the Writ Petition is disposed of. No costs.
